Maya’s MSB — Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between Maya’s MSB (“Maya’s MSB,” “we,” “us,” or “our”) and the parent, guardian, or authorized individual (“Client,” “you,” or “your”) accessing our website, creating a booking request, communicating with us, or receiving childcare services. By accessing or using mayasmsb.com, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Overview of Services

Maya’s MSB provides professional childcare and babysitting services. Maya’s MSB offers on-demand and scheduled babysitting, childcare, and additional support services (“Services”) through its website and communication channels. Services may include care provided directly by Maya’s MSB or by independent contractors engaged by Maya’s MSB.

All Services are subject to sitter or contractor availability, information provided by the Client, and safety conditions. We reserve the right to modify, pause, or discontinue any aspect of the Services at any time.

2. Booking Requirements & Eligibility

Bookings must be submitted through our online form, text communication, or approved booking system.

Clients must:

  • Provide accurate information about children, ages, special needs, allergies, pets, and home access.

  • Be at least 18 years old.

  • Be the parent, legal guardian, or authorized individual arranging childcare.

Maya’s MSB reserves the right to accept or decline any booking request.

3. Rates, Fees & Payment Terms

3.1 Rates

Rates for Services are listed on the Maya’s MSB website. Rates may vary by:

  • Number of children

  • Service duration

  • Time of day

  • Holidays

  • Travel distance

  • Special circumstances

3.2 Minimum Hours

A minimum booking length may apply and is stated on the Parent Policies page.

3.3 Payment Terms

  • Payment is due immediately at the end of the scheduled service unless otherwise stated in writing.

  • Accepted payment methods are listed on the website and in booking confirmations.

  • Outstanding balances may result in suspension of future services.

3.4 Additional Fees

Additional fees may include:

  • Overtime billed in 15-minute increments

  • Same-day or last-minute booking surcharges

  • Holiday rates

  • Cancellation fees as stated in Parent Policies

4. Cancellations, Late Fees & Refunds

  • Cancellations must be made within the timeframe listed on our Policies page.

  • Late cancellations incur the posted cancellation fee.

  • Late pickups or extended stays beyond booked hours will be charged at the applicable hourly rate plus any late fees

Refunds are issued only at our discretion and under circumstances deemed reasonable and/or appropriate by Maya’s MSB.

5. Parent & Guardian Responsibilities

Parents or guardians must:

  • Provide a safe, clean environment for the sitter and child(ren).

  • Provide emergency contact information.

  • Disclose all allergies, medications, behavioral needs, or relevant health information.

  • Ensure the sitter has safe home access (gated communities, codes, parking instructions, etc.).

  • Remain reachable during the entire service period.

  • Ensure no illegal, unsafe, or inappropriate tasks are requested.

Failure to provide accurate or complete information may result in refusal or termination of service.

6. Sitter Responsibilities

Sitters representing Maya’s MSB agree to:

  • Provide attentive, responsible care.

  • Follow all safety guidelines and household instructions provided.

  • Maintain professionalism and confidentiality.

  • Contact guardians immediately in emergencies or concerning situations.

    6.1 Independent Contractors

    Some Services may be provided by independent contractors. Clients acknowledge that:

  • Contractors are not employees of Maya’s MSB.

  • Maya’s MSB does not control every action of independent contractors.

  • Liability for actions of independent contractors is limited as described in Section 7.

  • Contractors are responsible for their own insurance, taxes, and professional compliance.

7. Liability & Disclaimer

To the fullest extent permitted by law:

  • Maya’s MSB is not liable for delays, cancellations, service interruptions, or events outside reasonable control.

  • The Client is financially responsible for any emergency-related expenses.

7.1 Assumption of Risk

Childcare activities involve inherent risks. By using the Services, you acknowledge and accept these risks.

7.2 Limitation of Liability

To the fullest extent permitted by law, Maya’s MSB is not liable for:

  • Minor injuries common to childcare environments

  • Damages arising from inaccurate or incomplete information provided by the Client

  • Accidents arising from household conditions or hazards

  • Delays, cancellations, or interruptions outside our control

  • Maya’s MSB is not responsible for accidents, injuries, damages, or losses resulting from unpredictable actions of children, pets, and household conditions.

7.3 Indemnification

  • Parents remain responsible for the condition and safety of their home environment.

The Client agrees to indemnify and hold harmless Maya’s MSB and its sitters from claims, damages, or expenses arising out of the Client’s breach of these Terms.


By booking, you acknowledge that childcare involves inherent risks and agree to hold Maya’s MSB harmless except in cases of proven negligence.

8. Prohibited Use of Services

Clients may not:

  • Provide false or misleading information.

  • Request non-childcare or unsafe tasks.

  • Threaten, harass, or endanger sitters.

  • Use the Services for unlawful purposes.

  • Interfere with or misuse the website or booking system.

Violation may result in immediate refusal of services and possible legal action.

9. Privacy & Communication Consent

By using our services, you consent to receive:

  • Scheduling updates

  • Policy notices

  • Service confirmations

  • Emergency communication

Communication may occur via text, email, or phone.

10. Changes to Terms

We may update these Terms as needed. The updated version will always be posted with a new “Last Updated” date. Continued use of our services means you accept the revised Terms.
